This is another case where the client first hired another lawyer that knew nothing about dealing with criminal investigations and DYFS cases. While the client was not yet arrested, he was facing both a DYFS case and a criminal investigation for allegedly molesting his 5 year old daughter. It took quite some time but our Somerset County Sexual Assault Defense lawyers were able to make sure that the criminal investigation was closed without any charges being filed against the client. The DYFS case however, was another story. It took a long time to fight the DYFS case because they fought so hard against our attorneys. However, our defense attorneys know how to fight even hard. We filed a number of motions to cripple the DYFS case. In the end, our motion to dismiss the case was granted by the judge.
In this case, the firm was hired to file a bail motion in Burlington County so that the client can be released from jail pending trial. The client was accused of molesting his children over a long period of time. By filing a hard-hitting bail motion, our molestation defense attorneys were able to get the client’s bail reduced by $250,000.
This was a tough case because the client actually admitted to molesting his daughter in a confession. This case involves a joint legal investigation by the Ocean County Prosecutor’s Office and DYFS into the allegations of one child molesting another. Although both parties are minors, these cases are still treated as very serious by law enforcement. We prevented the prosecutor’s office from interviewing our client and within a few weeks, our sexual assault defense attorneys had the criminal investigation dismissed. A few weeks later, our attorneys also had the DYFS case dismissed as well.

In this case, the client’s child was molested by the mother’s boyfriend. This client hired our DYFS lawyers after first handling the case with a lawyer that didn’t have much DYFS experience. As a result, there were some holes in the case that needed to be patched. The DYFS case was closed without having a fact finding hearing. Nevertheless, the client was still substantiated because he talked about his desire to molest his children in an interview. Thus, he had to file a DYFS OAL appeal. About six months after hiring the firm, our DYFS OAL appeal lawyers received word that his case was dismissed and that the finding of abuse and neglect was reversed.
This was a tough case because the client was accused of molesting his young son who happened to be autistic.
